These Terms & Conditions govern the use of hstones.com and the sale of memorial products and related services by HStones ("HStones," "Seller," "we," "our," or "us") to the customer ("Buyer," "you," or "your"). By using this website or placing an order, you agree to these Terms & Conditions.
1. Cemetery Approval
Each cemetery or memorial park may have its own rules regarding size, material, finish, design, thickness, and installation. You are responsible for confirming all cemetery requirements before placing an order.
If HStones assists with cemetery verification, that assistance is provided as a courtesy. Final responsibility for accuracy and compliance remains with the Buyer.
2. Orders and Approval
HStones will provide order details, layouts, proofs, or other approval materials before production begins where applicable. You are responsible for reviewing spelling, dates, artwork, dimensions, finish selections, and all other order details.
Once an order is approved and production starts, changes, cancellations, or restocking may not be possible or may result in additional charges.
3. Payment Terms
Payment terms are determined at checkout, by invoice, or by a separately agreed written quote. Unless otherwise agreed in writing, production may begin only after payment requirements have been met.
Payments are processed through third-party providers. By submitting payment information, you represent that you are authorized to use the selected payment method.
4. Custom Products and Refunds
Most HStones products are made to order or customized. Because of that, all sales may be final after design approval or after production begins, except where applicable law requires otherwise.

5. Shipping and Delivery
Delivery dates are estimates only. Production, shipping, freight scheduling, weather, carrier delays, and cemetery requirements may affect timing. HStones is not liable for delays outside its reasonable control.
Unless otherwise stated in writing, deliveries are curbside or standard carrier deliveries only. You are responsible for providing an accurate physical address and ensuring someone is available to receive the shipment if required.
6. Installation
If installation is not explicitly provided by HStones, you are solely responsible for arranging proper installation through the cemetery or a qualified third party. HStones is not responsible for damage, breakage, delays, or injury resulting from third-party handling or installation.
7. Natural Stone Variation
Granite, marble, and other natural materials vary in color, grain, veining, texture, and pattern. These variations are inherent characteristics of natural stone and are not defects. Product photos, samples, and renderings are illustrative and may not match the final product exactly.
8. Intellectual Property and Submitted Content
All content on this website, including text, images, graphics, logos, layouts, and software, is owned by HStones or its licensors and is protected by applicable intellectual property laws.
If you submit names, dates, artwork, photographs, symbols, or other content for engraving or design, you represent that you have the right to use that material. You remain responsible for the accuracy and legality of submitted content.
9. SMS Communications
If you opt in to receive text messages from HStones, you agree to receive messages related to customer service, order updates, approvals, scheduling, and, where separately permitted, promotional messages. Message frequency may vary. Standard message and data rates may apply.

10. Limitation of Liability
To the fullest extent permitted by law, HStones shall not be liable for indirect, incidental, special, exemplary, or consequential damages arising out of or related to the website, products, shipping, installation, delays, cemetery rejection, or use of our services.
HStones' total liability for any claim related to an order shall not exceed the amount actually paid by the Buyer for the specific product or service giving rise to the claim.
11. Governing Law and Disputes
These Terms & Conditions are governed by applicable laws of the United States and the state applicable to the transaction, without giving effect to conflict of law rules. The parties agree to attempt to resolve disputes in good faith before initiating formal proceedings.

HStones may revise these Terms & Conditions at any time by posting an updated version on this page. Continued use of the website or continued transactions after such updates constitutes acceptance of the revised Terms.
